PRIMA TERMS OF USE
The PriMa job portal is a portal provided by Kleinwalsertal Tourismus eGen. Use of the PriMa job portal is at your own risk and responsibility.
The job portal is available to persons over the age of 18. Persons under the age of 18 require the consent of a parent or legal guardian, who must provide the legally required declarations.
If users from countries other than Austria use the portal, the age of majority provisions of that country apply.
For reasons of simplification and better comprehensibility, but not for reasons of discrimination, personal references are used in the masculine form only.
The following terms of use apply to the use of the portal:
§1. USE OF THE PORTAL AT HTTPS:/ /PRIMA.KLEINWALSERTAL.COM
(1) Any natural or legal person is entitled to use the portal. Natural persons must be of legal age and have legal capacity; minors require the consent of their parents or other legal guardians.
(2) Only members of Kleinwalsertal Tourismus eGen with registered office in the municipality of Mittelberg are entitled to post job offers on the portal.
(3) Kleinwalsertal Tourismus eGen reserves the right to supplement or amend these terms of use.
§2. COPYRIGHT, RIGHTS OF USE, COMPETITION PROTECTION
(1) Users grant Kleinwalsertal Tourismus eGen, all other users of the portal and cooperation partners of the PriMa job portal the simple, spatially and temporally unlimited right to use the offers posted for the purpose of job/personnel and training placement.
(2) The copyright to the database and content of the portal as well as to the software used lies with Kleinwalsertal Tourismus eGen. The user is responsible for ensuring that any use of the programme by them or by third parties takes place within the scope of the user agreement. The user is prohibited from using or reproducing the database and content of the portal in whole or in part. They are also prohibited from using the offers posted in the database for purposes other than those directly related to the initiation and commencement of training or employment relationships or self-employed activities, the use and reproduction of the offers posted in the database and their contents by third parties for their own placement or advertising purposes without the user's consent, reproduction, distribution, exhibition, performance, presentation or broadcast, as well as reproduction by means of image or sound carriers or radio broadcasts from the PriMa Job Portal.
(3) In particular, the user is not permitted to copy, extract or evaluate the content of the PriMa Job Portal in any technical manner for any purpose whatsoever, or to import their own data into the portal by technical means.
(4) Kleinwalsertal Tourismus eGen reserves the right to assert all rights in the event of a breach of the above provisions, whether civil or criminal.
§3. MISUSE AND VIOLATION OF TERMS OF USE/COMPENSATION
(1) Kleinwalsertal Tourismus provides the PriMa job portal as a service. In the event of misuse and violations of the terms of use, Kleinwalsertal Tourismus eGen is entitled to remove content and delete the user account immediately without notifying the user.
(2) By agreeing to these terms of use, the user declares that the offers and events they post do not violate these terms of use or applicable law.
(3) The user may not violate legal prohibitions, morality or the rights of third parties, in particular intellectual property rights (copyrights, image rights, etc.), through the form, content or purpose of their posted offers.
§4. LIABILITY
(1) When providing personal data, the user is responsible for the accuracy of the information provided about themselves and any intended additions or changes, as well as its technical and functional aspects. These requirements form the basis of the user relationship. The user who posted the job offers on the portal is solely responsible for these offers. The user warrants that the information provided in the application about themselves and other circumstances relevant to the user relationship is complete and correct.
(2) Kleinwalsertal Tourismus eGen does not check the job offers posted by users. Accordingly, Kleinwalsertal Tourismus eGen is not liable for the accuracy, completeness and legal admissibility of information posted on the PriMa job portal.
(3) Kleinwalsertal Tourismus eGen is not liable for the content of other websites linked within the PriMa job portal, but reserves the right to remove links upon becoming aware of illegal content.
(4) Kleinwalsertal Tourismus eGen is not liable for damage in connection with computer viruses or similar harmful mechanisms that arise from the posting of offers by third parties or links to third-party websites.
§5. DETAILS OF USE
(1) The PriMa job portal is a portal provided by Kleinwalsertal Tourismus eGen for viewing job offers, training opportunities and applicant profiles, or for posting your own offers. Any changes to the content must be updated in the existing offer.
(2) Any misuse of the PriMa portal, even if only partial, is prohibited.
(3) Kleinwalsertal Tourismus eGen treats all user data entered as confidential and limits its disclosure to the fulfilment of the purpose of these terms of use. All users of the portal are required to treat the data of applicants (or contacted companies) as confidential.
(4) Job providers must ensure that their job advertisements are gender-neutral and contain all information relevant to the application decision.
(5) Job providers must also ensure that the offers they post do not violate any legal regulations, in particular employee rights, or are misleading. Their offers must not incur any costs beyond the usual amount, unless the costs are required by law or regulated in any other way.
§6. PRIMA JOB PORTAL RIGHTS
(1) Kleinwalsertal Tourismus eGen does not guarantee that the services offered on the PriMa Portal will be available at specific times. Kleinwalsertal Tourismus eGen cannot rule out disruptions, interruptions or a possible failure of the online service.
(2) Kleinwalsertal Tourismus eGen reserves the right to change, expand, restrict or completely discontinue this service at any time or to delete data at any time without further notice. You have no right to publication.
§7. PLACE OF JURISDICTION
(1) The place of jurisdiction for all disputes arising from this user relationship is Bezau. For non-merchants, the statutory provisions of the Civil Procedure Code (§§ 12 ff. ZPO) apply.
(2) The law of the Republic of Austria applies exclusively to contracts concluded by Prima Jobportal on the basis of these Terms of Use and to any claims arising from them, regardless of their nature.
§8. SEVERABILITY CLAUSE
(1) Should any provisions of these Terms of Use be or become invalid, this shall not affect the validity of the remaining provisions.
(2) The invalid provision shall be replaced by a provision that comes as close as possible to the intention of the parties and is best suited to achieving the desired objective.
